Legislative Changes

The Denison City Council will receive a report, hold a discussion, and take action on an ordinance amending Chapter 15 of the City of Denison Code of Ordinances.

The proposed changes specifically target Article III, which covers mobile food vendors, to ensure compliance with Texas House Bill 2844 from the 89th Texas Legislature.

Retained Local Authority

House Bill 2844 establishes Chapter 437B of the Texas Health and Safety Code, which preempts local governments from handling food safety permitting for mobile food vendors.

The state will assume responsibility for food safety licensing and inspections through the Texas Department of State Health Services.

The city will maintain regulatory control over zoning, land use, fire code compliance, traffic, parking, noise, hours of operation, public safety, and special event permitting.

Current Regulatory Framework

The city currently manages food safety compliance through its own permitting and inspection processes.

These local efforts are conducted in partnership with the Grayson County Health Department.
